1. Acceptance of Terms
By accessing or using adivaha.HR (the "Service"), operated by adivaha (“Company,” “we,” “us”), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.
2. Description of Service
adivaha.HR is a cloud-based human resource management platform that provides employee management, attendance tracking, leave management, payroll processing, performance reviews and people analytics tools for businesses of all sizes.
3. Account Registration
To use the Service you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
4. Subscription & Payments
- Paid plans are billed monthly or annually as selected at the time of purchase.
- All fees are exclusive of applicable taxes unless stated otherwise.
- We reserve the right to change pricing with 30 days' prior written notice.
- Refunds are handled in accordance with our refund policy available on the pricing page.
5. Free Trial
We may offer a 14-day free trial. No credit card is required during the trial period. At the end of the trial, your account will be downgraded unless you subscribe to a paid plan. We reserve the right to modify or discontinue free trials at any time.
6. User Responsibilities
- You agree not to use the Service for any unlawful or prohibited purpose.
- You shall not attempt to gain unauthorised access to any part of the Service.
- You are solely responsible for the data you upload, store or process through the Service.
- You agree not to reverse engineer, decompile or disassemble any part of the Service.
7. Data Ownership
You retain full ownership of all data you submit to the Service. We do not claim any intellectual property rights over your data. We process your data solely to provide and improve the Service as described in our Privacy Policy.
8. Intellectual Property
All content, features, functionality, trademarks, logos and branding of adivaha.HR are the exclusive property of the Company and are protected by intellectual property laws. You may not reproduce, distribute or create derivative works without our prior written consent.
9. Service Availability & SLA
We strive to maintain 99.9% uptime. However, the Service may be temporarily unavailable due to scheduled maintenance, updates or circumstances beyond our control. We are not liable for any loss arising from temporary downtime.
10. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with the use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your access if you violate these Terms. You may cancel your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
13. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
